  • Wills & Trustees. [Warning}

    I have been hearing a lot of adds for public trustees and we seem to be on their spam mailing lists as well. Their blurb sounds very caring and like you just got to ring them ASAP to let them make your will. DONT !Everyone should have a will, if you havent or a public trusttee has done your will then read on.These trustee firms sound very good and they do know their stuff, problem is that when you make them the executor of your will, you are passing them your cheque book...once you are deceased !!Going back into the 70"s, a long time ago, I know of a case where Elders trustees were the exuctors of a will that had a very substantial amount of cash in the bank at the time this bloke died. The trustees by the time they had finished, which took about twice as long as it should have with a family member as executor, had very little cash left, some $300 thou had been eaten up in charges of many various types, all legal apparently as some of the family engaged a solictor to check. Moral of the story is that do not engage a public or for that matter, any trustee to write or administer your will. The family lawyer can write your will and in some basic cases, a will kit form a newsagent can be used. An important bit is naming an excutor as this person needs to be a trustworthy person who you know will carry out the instructions left in the will. As long as you are fairly precise in puting down how you wnat whatever you got, dished out, then the job is simple as for an excutor as the lawyer does the boot work anyway plus....and this is the important part, unlike the trustee compnay, your excutor wont charge you a fee, sure you got to pay the lawyer but you do that with the trustee mob as well.Anyway, if you dont have a will, dont put it off, even if you only have a car and a dog, make a will as if you die without a will, a admistrator will be appointed by a court and who knows where your dog is going to finish up.....after 5 years of court wrangling between the admistrator and the dog
